This memo is in response to the company’s decrease in sales and profit because of the current state of the economy. The company will be executing more cost-effective measures because of this present situation. These new procedures will begin immediately with approval from the company owners. The first change will be a reduction in the monetary incentives for the sales department. To be successful in implementing this change a complete understanding of the sales process is mandatory. Consumer and salespeople feedback will be instrumental in gathering the data necessary to make a concise and informed decision on the best way to reduce the incentives for every party involved. The first step in the decision-making process is determining the facts of the situation at hand (Hartman & DesJardins, 2011, p. 47). The facts are that the company is losing income because of the economy. Additionally known is the company profits are on the finished product that meets the need of the consumer. A written survey will ascertain what the specific needs and wants of the consumer toward a particular product are. Once the feedback is analyzed, the products most in demand by the consumer will continue with production, whereas the products in less demand will begin interruption until the sales or the demand from the consumer are in need. This step will aid in cutting costs for products with unnecessary production. As an example, there was a significant increase in sales the first few years, opposed to last year’s sales that decreased substantially for the products not in demand. By investigating and discovering products in demand will aid in painting a clearer picture, thus assisting in cutting production cost that will get the company back in line with increasing sales and profits. Additionally, investigating and discovering will keep the plan of reducing monetary incentives for the sales force until sales and profits are on the increase again. However, the plan is to once again start issuing monetary incentives to the sales force once the company starts again seeing an increase in sales and profits. For this plan to be successful it will be necessary to motivate the sales force with tools to set achievable goals relating to increasing company sales and profits. This also has a direct impact on the sales force pertaining to the company’s organization and management. Upper management as well as the owners of the company has to be on the same accord concerning aiding the sales department in reaching their goals by providing motivation and support to the sales department. A strong support system is imperative if the sales team along with the organization is to reach their primary objectives. This plan will also include evaluations on the progress of the sales department pertaining to reaching their goals. The second and final change will be implementing a month-long layoff for some of the production employees. Laying-off production workers for a month will cut production costs of producing products unnecessary for the economy. While keeping in mind that this layoff will also have an adverse result on producing products in demand. Instead of laying off production workers, the more cost-effective way would be to keep them at work to help meet the current demand for products. The workers still working with the organization will receive more overtime, and this is not cost-effective because the result is increasing payroll for employees. Although removing monetary incentives for the sales department and laying-off a portion of the production department is legal, it does nothing for morale. Ethically there will be some repercussions to implementing these changes. Some of the repercussions may include employees leaving the organization and a decline in sales means possible bankruptcy. Implementing a more amicable plan will have a more positive influence that will promote a higher morale and happiness. With a higher morale, this will more likely promote a boost in productivity.

There is a thin line that goes between persuasion, manipulation, and being downright unethical. There is a huge difference between what is persuasive and what is manipulative or unethical. However, there is a certain degree wherein these ideas come into a junction. Perhaps, the shared meaning between these words is influenced and is dependent on the objective and the intention of the speaker. To be clear on the similarities and or differences of these words, the definition of each must be placed into position. Persuasion is an act of influencing or pleading others to understand and recognize certain ideologies, beliefs, viewpoints, etc. Manipulation, on the other hand, is a form of social control wherein others are dealt with forcefully, capably, or cleverly, to bring about an end that is beneficial to the manipulator. (Merriam-Webster, 2008) Judging by the definition of the word ‘manipulation’ makes it unethical. If persuasion were a form of influence, then it would be accurate to establish the idea that in persuading an audience, there is a sense of sending out information and enlightening the audience to sway and encourage them to believe in or adhere to an idea. Manipulation on the other hand is a more dynamic  Ã‚  Ã‚   way of bringing about action and change to the audience. (Sager, 2008) If it is a cleverly way to win over an audience and controlling them to accomplish an objective, it would also be precise to establish the idea that in manipulation, there might be a tendency to go beyond what is ethical, such as covering-up the truth, to make people believe in or adhere to an idea. Thierry knelt by the window, careful not to make a noise or disturb the dry earth beneath him. It was a skill so familiar to his body that he might have been born with it. Just the curve of her shoulder and the spill of her hair, but he knew it was her. Beside him, Lupe was crouched, her thin body human but quivering with animal alertness and tension. She whispered, softer than a breath, â€Å"All right?† Thierry tore his gaze from that shoulder to look at her. Lupe's face was bruised, one eye almost closed, lower lip torn. But she was smiling. She'd stuck around Medicine Rock until Thierry had arrived, tailing the girl called Hannah Snow, making sure no harm came to her. Thierry took Lupe's hand and kissed it. She had to stand up. †¦ Hana of the Three Rivers stood up. â€Å"Everybody's all excited by the river' she told Ket. â€Å"Maybe Ran fell in,† Ket said. â€Å"No, that's too much to hope for. Hana, what am I going to do? He wants to mate me, but I just can't picture it. I want somebody interesting, somebody different. . . ,† She held up the half-finished necklace. â€Å"So what do you think?† Hana barely glanced at her. Ket looked wonderful, with her short dark hair, her glowing slanted green eyes, and her mysterious smile. The necklace was attractive; red beads alternated with delicate milky-white teeth. â€Å"Fine, beautiful. You'll break every heart at the gathering. I'm going down to the river.† Ket put down the necklace. â€Å"Well, if you insist- wait for me.† The river was broad and fast-flowing, covered with little white-capped waves because it had just been joined by two tributaries. Hana's people had rived in the limestone caves by the three rivers for longer than anyone could remember. Ket was behind her as Hana made her way through new green cattails to the bend in the river. And then , she saw what the fuss was about. There was a stranger crouching in the reeds. That was exciting enough-strangers didn't come very often. But this stranger was like no man Hana had ever seen. â€Å"It's a demon,† Ket whispered, awed. It was a young man-a boy a few years older than Hana herself. He might have been handsome in other circumstances. His hair was very light blond, lighter than the dry grass of the steppes. His face was well-made; his tall body was lithe. Hana could see almost all of that body because he was only wearing a brief leather loincloth. That didn't bother her; everybody went naked in the summer when it was hot enough. But this wasn't summer; it was spring and the days could still be chilly. No sane person would go traveling without clothes. But that wasn't what shocked Hana, what held her standing there rigid with her heart pounding so hard she couldn't breathe. It was the rest of the boy's appearance. Ket was right-he was clearly a demon. His eyes were wrong. More like the eyes of a lynx or a wolverine than the eyes of a person. They seemed to throw the pale sunlight back at you when you looked into them. But the eyes were nothing compared to the teeth. His canine teeth were long and delicately curved. They came to a sharp and very non-human point. Almost involuntarily, Hana looked down at the fox tooth she still held in her palm. Yes, they were like that, only bigger. The boy was filthy, caked with mud from the river, his blond hair ruffled crazily, his eyes staring wildly from side to side. There was blood on his mouth and chin. â€Å"He's a demon, all right,† one of the men said. Five men were standing around the crouching boy, several of them with spears, others with hastily grabbed rocks. â€Å"What else could have a human body with animal eyes and teeth?† â€Å"A spirit?† Hana said. She didn't realize that she was going to say it until the words were out. But then, with everybody looking at her, she drew herself up tall. â€Å"Whether he's a demon or a spirit, you'd better not hurt him. It's Old Mother who should decide what to do with him. Avoiding Future Frauds with the Sarbanes-Oxley Act Essay

It is clear that the establishment of the Sarbanes-Oxley (SOX) act in 2002 was specific to reducing future financial fraud and imposing criminal penalties for publicly traded companies. What is not clear is whether or not the act has proved to be successful in its implementation and governance. The establishment of the act and subsequent amendments are intended to protect the public from fraud in the financial accounting of publicly traded corporations. In 2002, there were opinions both for and against the effectiveness of SOX. More than a decade later, there are still opinions on both sides of the debate. Criticism of the Sarbanes-Oxley Act The effectiveness of the Sarbanes-Oxley act has been highly criticized since its inception. One of the major contentions is that the Sarbanes-Oxley act has no provisions to differentiate the requirements for small publicly traded businesses from large conglomerates (that lead and often monopolize the marketplace). Publicly traded companies that are small in size may find the costs of compliance prohibitive to the future of their business (Coustan, 2004). Critics of SOX believe that this unnecessarily reduces the number of players in a competitive marketplace. The cost of compliance can be excessive for some smaller companies. Auditing expenses cause companies to seek private investment and become privately owned (San Antonio Express-News, 2007). Ten years ago, critics expressed â€Å"fears that small, publicly listed companies might not meet internal control reporting requirements without substantial additional expense; some may have to delist because of it. It could mean only larger companies will go public† (Coustan, 2004, p. 1). In recent years, this debate continues. Critics still express concerns â€Å"that Sarbanes-Oxley is overreaching and has placed unnecessary  restrictions on corporations that have and will continue to unduly inhibit corporate performance until they are removed† (Brite, 2013). Another major contention of critics is that the costs of compliance for outweigh the benefits in an international marketplace. Those against SOX feel that the costs outweigh the benefits and speak out in public forums stating that the â€Å"Sarbanes-Oxley has burdened the US financial market with costly rules and regulations that have reduced international competitiveness† (debate.org, 2014). There are those that openly share the opinion that the implementations of regulatory overkill through the 2002 Sarbanes-Oxley act â€Å"wrongfully make the innocent suffer for the guilty† (Gilmore, 2013). The reporting requirements of SOX are specific to businesses in the United States. Unlike American business, international business does not have the same requirements. â€Å"Regulatory compliance opposes economic costs on organizations and can affect their competitive advantage† (Srinivasan, 2014, p. 44). Increasing the cost for American business decreases competitive advantage in the worldwide marketplace. In addition to cost and competitive advantage, the structure of the bill has also been called into question. The Court of Appeals recently found difficulty with the wording of the amended 18 USC, citing that â€Å"paragraph (b) of the statute includes the word â€Å"knowingly† while paragraph (c) does not† (Bishop, 2013). The opinions of the Court of Appeals lends to the public opinion expressed in published CPA perspectives that â€Å"SOX was a hastily assembled bill† (Moran, 2013). Involved and cumbersome requirements cause confusion and frustration for companies attempting to comply with the Sarbanes-Oxley act even more than a decade after its implementation. Companies and lawmakers alike have had difficulty over the years with the interpretation of and compliance with the act. â€Å"SOX brought about many changes to the way public companies had to operate, and there was some question as to how these would stand up over time† (Moran, 2013). Positive Aspects of the Sarbanes-Oxley Act Despite complaints by critics, there are positive aspects of the Sarbanes-Oxley act that have withstood the test of time. Initial reactions have softened after smaller businesses were granted some relief in later amendments of the act. Larger businesses found that compliance with the act  increased investor confidence and contributions. In addition, the resultant increase in financial transparency has improved business relationships on many levels. First and foremost, there are many of the opinion that the enactment of the Sarbanes-Oxley act increased investor confidence and protection in the marketplace. â€Å"Does Sarbanes-Oxley prevent all bad actors from defrauding investors? No law could accomplish that. But it can and has deterred such activity† (Gillian, 2012, p. 1). Those in support of the Sarbanes-Oxley act agree that there is a positive side for investors and the businesses in which they invest. â€Å"A 2005 survey by the Financial Executives Research Foundation f ound that 83 percent of large company CFOs agreed that SOX had increased investor confidence, with 33 percent agreeing that it had reduced fraud† (Hanna, 2014, p. 2). With an increase in confidence and a perceived reduction of fraud, investors could more confidently make intelligent business decisions on the purchase and sale of publicly traded companies. Those on the positive side of the SOX act believe that the effects on small business have softened. Studies show that as companies become more accustomed to the costs of compliance, the expense decreases (San Antonio Express-News, 2007). In addition, the effects on smaller companies were ultimately deferred. â€Å"Audit standards also were modified in 2007, a change that reportedly reduced costs for many firms by 25 percent or more per year† (Hanna, 2014, p. 1). Although the costs of compliance decrease retained earnings, investors are more confident in the reliability of company reports (Gillian, 2012). â€Å"The cost of being a publicly traded company did cause some firms to go private, but research shows these were primarily organizations that were smaller, less liquid, and more fraud-prone† (Hanna, 2014, p. 1). These modifications of the act allowed more small businesses to remain competitive in the marketplace. Business relationships have also improved with increased transparency. The reduction of information asymmetry is a direct benefit to both the company and the investors. â€Å"Information asymmetry is a situation in which one party in a transaction has more or superior information compared to another† (Brite, 2013, p. 1). Periodic testing of internal controls required by SOX 404, increases transparency among internal and external stakeholders of the business. The American Institute of CPAs states on their website that â€Å"section 404B has led to improve financial reporting and greater  transparency† (American Institute of CPAs, 2006 – 2014). Conclusion and Opinion To evaluate the effectiveness of SOX in preventing future frauds, one must take into consideration the many different situations in which the legislation is applicable. Enactment of the Sarbanes-Oxley act increases corporate responsibility and sets restrictions on auditor services. This certainly reduces the potential for fraud; however it does not eliminate it. From a business perspective, compliance is beneficial. The costs of implementing the requirements may be high; however the benefit of increased investor confidence in a publicly traded environment is higher. There are going to be situations in which fraud is inevitable. Fraudulent wrongdoers and companies will find loopholes and the recent Court of Appeals case is evidence of that fact. The narrator of The Tell Tale Heart seems and convincingly was a mentally unstable person who was dangerous and lost his control in his life, his obsession led to his destruction eventually. He felt hostile about his identity and wanted to stay anonymous. From the beginning he tried to protect his view about life as correct and his over imaginative and suspicious nature as peculiar sensitivity of sensing danger around. The narrator of â€Å"The tell tale heart† is a killer of an innocent man. The narrator of the story seemed well planned and gave acute time to his course in action, leaving no choice for the victim at all. The Tell Tale heart’s narrator waited for 7 nights and murdered the already scared man randomly on the 8th night. The factor of fear is even involved here; he could not stand the fear of his pale blue eyes. The tell tale heart’s narrator was a confused mind person who refused to be insane but did admit the fact that his actions were of a right cause and planned until he chopped the body and hid it under the floorboards. Due to his heighten sensitivity of listening to different sounds, he was unable to distinguish between the real and imaginative sounds so he confessed his crime and but did call the police officers villain as he could not distinguish between his own actions which were vicious. The Tell Tale Heart is the story which describes the feelings of conflict within a person. Perspectives on Free-Speech Zones on College Campuses Essay Naturally, many negative connotations come along with the term â€Å"free-speech zone. † The wording alone automatically insinuates that free speech should not be allowed everywhere, which is hardly the true intention of the idea. Sometimes the right of free speech is taken advantage of; such as in certain rallies and protests, where disruptive noise, violence, and destruction often occurs. Universities hold a responsibility to their students of providing a reasonably safe and undisruptive environment to learn and excel in. Universities are not creating â€Å"free-speech zones† to limit free speech, but rather to maintain a secure atmosphere that is conducive to concentration and higher learning. Universities should be able to maintain a certain level of safety on campus in whatever way they choose. â€Å"The University reserves the right to relocate or cancel the activity due to disruption from excessive noise levels, traffic entanglement, or if the safety of individuals is in question† (West Virginia University’s Student Handbook 91). They are not undermining the right of free speech that we as Americans legally hold, but are creating an appropriate means for demonstrators to voice their opinions without causing unnecessary disruption and chaos in inappropriate places on campus. If what constitutes the use of a â€Å"free-speech zone† was better defined then the use of such â€Å"zones† could be more affective and appropriate. As stated by Robert J. Scott, protest zones have been used at many political conventions and other major events. â€Å"Protest zones can be reasonable restrictions that allow free-speech rights to be expressed while decreasing safety concerns and preventing undue disruption† (Scott 92). With the history of violence and destruction that is associated with protests, it is only natural that certain precautions be taken to prevent such problems. It is too vague to say the free expression of views or opinions may not â€Å"disrupt the normal function of the university,† as stated in the West Virginia University’s student handbook. Who decides what the â€Å"normal function† truly is, or when it is being â€Å"disrupted? † If a university decides to establish the use of â€Å"free-speech zones† then they should be able to provide a clear and concise description of when, and for what purpose, these â€Å"zones† should be used. One of a universities top priorities is to make their campus as safe and secure as possible, and if â€Å"free-speech zones† or â€Å"protest zones† are what they feel are necessary to maintain that security then they should be able to enforce them. The problem really comes down to whether or not these â€Å"zones† are used appropriately. If used extensively, and at levels that are unnecessary for the safety of students, then human rights issues could easily come into play. But if used in a smart way, such as for larger demonstrations of freedom of speech, like protests and rallies, then they could be helpful in preventing destruction and/or distraction on university campuses. â€Å"Requiring those expressing dissent to obey the law while doing so does not constitute repression† (Scott 92).
